Equipment Rental Policy

Please review the following rental policies before renting equipment from Peninsula Excavating. These policies summarize important requirements for the safe use, care, and return of rental equipment. The complete Equipment Rental Agreement contains the full terms and conditions of each rental.

Rental Period

Rental equipment must be returned by the end of the rental period listed on the rental agreement.

If additional rental time is needed, please contact Peninsula Excavating and Landscaping before the rental period ends. Extensions must be approved in writing.

Returning equipment early does not automatically reduce the rental charge. The minimum rental period remains payable unless otherwise agreed upon.

Rental Rates & Fees

Rental rates are based on the applicable daily, weekly, or monthly rate.

Additional charges may apply, including:

  • Michigan sales/use tax
  • Fuel charges
  • Delivery and pickup fees
  • Damage waiver fees, if applicable
  • Applicable repair, cleaning, or other charges

A refundable security deposit may be required. The deposit may be applied toward unpaid rental charges, late fees, repair costs, cleaning charges, or other amounts owed.

Equipment Inspection

Customers are responsible for inspecting equipment before taking possession.

Please check the equipment for any visible damage, mechanical issues, missing components, or other concerns before leaving with the equipment.

Any pre-existing damage, defects, or missing components should be reported and documented at the time of pickup or delivery. If damage is not documented at that time, the equipment may be presumed to have been delivered in good working condition.

Equipment is rented “AS IS, WHERE IS.”

Equipment Use

Rental equipment must be used only for its intended purpose and operated in a careful and lawful manner.

Customers are responsible for ensuring that:

  • Equipment is operated only by qualified and trained operators.
  • Equipment is not operated beyond its rated capacity.
  • Unauthorized individuals do not operate the equipment.
  • All applicable federal, state, and local laws are followed.
  • Equipment is not used for a purpose for which it was not designed.

Equipment may not be subleased, assigned, or transferred to another party without prior written approval.

Equipment may not be removed from the job site or location provided to Peninsula Excavating and Landscaping without prior written consent.

Equipment Care & Maintenance

Customers are responsible for routine daily maintenance during the rental period, including checking fluid levels, fuel, tire pressure, and lubrication as applicable.

Any malfunction, warning light, or unusual operating condition should be reported to Peninsula Excavating and Landscaping promptly.

If equipment becomes unsafe to operate, discontinue use immediately and contact Peninsula Excavating and Landscaping.

Returning Equipment

Equipment must be returned to the designated location by the end of the rental period.

Equipment should be returned:

  • In the same condition as when received, except for ordinary wear and tear
  • Clean
  • Fueled to the level provided at pickup
  • With all original attachments and accessories

Customers may be responsible for reasonable repair, replacement, or cleaning costs resulting from damage beyond ordinary wear and tear.

Additional loss-of-use or downtime charges may apply if equipment is unavailable for rental while being repaired or cleaned.

Late Returns

Equipment that is not returned by the end of the rental period may be subject to additional rental and late fees.

Late equipment is subject to a 150% holdover rental charge based on the applicable daily rental rate for each day or partial day that the equipment remains unreturned.

Additional late fees may also apply as outlined in the rental agreement.

Late charges continue until the equipment is returned and accepted by Peninsula Excavating and Landscaping or repossessed by the company.

Towing Requirements

When equipment or trailers are towed by the customer, the customer is responsible for ensuring that the towing vehicle and equipment are properly matched, connected, loaded, and operated.

Before towing, customers must verify:

  • The hitch, ball, and coupler are properly matched and securely latched.
  • Safety chains are properly attached.
  • The breakaway cable is connected, when applicable.
  • Trailer and towing vehicle lights, brakes, and signals are functioning.
  • Tires are properly inflated and in safe condition.
  • The load is properly secured and balanced.
  • The trailer and towing vehicle are within their rated capacities.

Customers are responsible for ensuring that their towing vehicle is legally and safely equipped for the equipment being towed.

Towing Risks

Towing equipment involves inherent risks, including loss of vehicle control, trailer sway, rollover, detachment, collision, property damage, and personal injury.

Customers who tow equipment assume responsibility for risks associated with their towing vehicle, loading and securement, road or weather conditions, and their own actions or those of their employees, agents, or contractors, except to the extent caused by Peninsula Excavating and Landscaping’s gross negligence or willful misconduct.

Insurance Requirements

Customers are responsible for maintaining the insurance required under the Equipment Rental Agreement.

Required coverage includes:

  • Valid Michigan No-Fault insurance for applicable towing operations
    Commercial general liability insurance with limits of at least $1,000,000 per occurrence
    Property/equipment insurance covering the full replacement value of the rented equipment, including theft
  • A certificate of insurance naming Peninsula Excavating and Landscaping as an additional insured and loss payee may be required before equipment is released.

Damage, Loss & Theft

Customers are responsible for the equipment from the time it is delivered or picked up until it is returned and accepted by Peninsula Excavating and Landscaping.

Customers may be responsible for the repair or replacement cost of equipment that is lost, stolen, or damaged beyond ordinary wear and tear during the rental period.

Customer Responsibility

Customers are responsible for:

  • Safely operating rented equipment
  • Using qualified operators
  • Following all applicable laws and safety requirements
  • Properly caring for and maintaining equipment
  • Reporting damage or mechanical issues promptly
  • Protecting equipment from damage, loss, and theft
  • Returning equipment on time
  • Returning equipment clean and properly fueled
  • Returning all attachments and accessories provided with the equipment
